1. Acceptance of Terms
By downloading, installing, and using Ergomi (“App,” “Service,” “we,” “us,” “our”), you agree to be bound by these Terms of Service (“Agreement”). If you do not agree, do not use the Service.
2. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use Ergomi on your personal mobile device for personal, non-commercial use only. You may not:
- Modify, reverse-engineer, decompile, or create derivative works
- Rent, lease, lend, or transfer the app
- Use the app for commercial purposes without written permission
- Remove copyright, trademark, or proprietary notices
- Access the app through automated means or bots
3. User Responsibilities
3.1 Accurate Information
You agree to provide accurate and complete information when setting up your profile (age, weight, max heart rate, FTP, etc.). Inaccurate biometric data may result in less accurate coaching advice.
3.2 Safety & Medical Advice
Ergomi is NOT a medical device. The coaching guidance, heart rate zones, and training load metrics are educational and based on common endurance training principles, not personalized medical advice.
- Consult Your Doctor: Before starting any new exercise program, especially if you have cardiovascular, respiratory, or orthopedic conditions
- Listen to Your Body: Disregard coaching advice if it feels unsafe or causes pain
- Heart Rate Zones: Are estimated based on age and max HR. Consult a sports medicine professional for personalized zones
- Wearable Integration: Health Connect data (HRV, sleep) is used for readiness estimation, not medical diagnosis
3.3 Hardware Safety
When using Ergomi with connected hardware (rowing machines, smart trainers, sensors):
- Ensure all equipment is in good working condition
- Follow manufacturer safety guidelines for your hardware
- Use the app in a safe, supervised environment
- Stop immediately if you experience chest pain, severe shortness of breath, or dizziness
3.4 Acceptable Use
You agree not to:
- Use the app to track or harm others
- Share your login credentials
- Engage in illegal activity
- Harass, threaten, or abuse other users
- Attempt to hack or compromise the app’s security
4. Warranty Disclaimer
4.1 As-Is Service
Ergomi is provided “AS IS” without warranty of any kind, either express or implied.
4.2 No Guarantees
We do not guarantee:
- Accurate coaching advice in every situation
- Compatibility with all devices or Android versions
- Uninterrupted service or uptime
- Accuracy of GPS, heart rate, or power measurements
- Successful sync with Health Connect, Strava, or other third parties
- Availability of every voice pack, TTS engine, or optional integration on every device
4.3 Hardware Compatibility
Some features (Bluetooth connections, Health Connect, GPS) depend on your device’s hardware and OS version. We are not liable if these features are unavailable on your device.
5. Limitation of Liability
To the fullest extent allowed by law, Ergomi and its creators are not liable for:
- Loss, corruption, or deletion of workout data
- Injuries sustained during workouts (including reliance on app-provided coaching)
- Loss of revenue or business opportunities
- Data breaches or unauthorized access (with reasonable security practices in place)
- Third-party service failures (Strava, Health Connect, etc.)
- App crashes, bugs, or performance issues
- Inaccurate metrics or biometric calculations
5.1 Cap on Liability
Our total liability is capped at the amount you paid for the app (if any). If the app is free, our liability is $0.
6. Assumption of Risk
You acknowledge that:
- Endurance training involves physical exertion and carries inherent risks
- You use this app at your own risk
- You are solely responsible for deciding whether and when to exercise
- You have the physical capability to engage in the activities you track
- You assume all risks of injury or illness
7. Data & Intellectual Property
7.1 Your Data
You retain ownership of all workout data you create (sessions, routes, custom workouts). We do not own your health data.
7.2 Our IP
All app code, algorithms, UI design, and coaching logic (“Ergomi IP”) are owned by us and protected by copyright and trademark law. You may not reproduce, distribute, or commercialize our IP.
7.3 License to Your Data
By using Ergomi, you grant us a non-exclusive license to use your aggregated, anonymized workout data (e.g., “users average 8 workouts/month”) for research and app improvement. We will not identify you personally in any analysis.
8. Third-Party Services
8.1 Strava
If you export workouts to Strava:
- Your exported file is governed by Strava’s Terms of Service
- We are not liable for Strava’s handling, loss, or misuse of your data
- You are responsible for managing your Strava privacy settings
8.2 Health Connect & Wearables
- Health Connect access is managed by Android
- Data shared via Health Connect is governed by the respective app’s terms
- We do not control third-party wearable apps or their data practices
9. Termination
We reserve the right to suspend or terminate your access to the Service if you:
- Violate these Terms
- Engage in illegal activity
- Attempt to harm the Service or other users
- Misuse the app in ways that violate applicable law
Upon termination, you retain your on-device data but lose access to the app.
10. Modifications to the Service
We may update, modify, or discontinue Ergomi at any time, with or without notice. We are not liable for any loss of data or service interruption due to maintenance, updates, or discontinuation.
11. Indemnity
You agree to indemnify and hold harmless Ergomi and its creators from any claims, damages, or legal fees arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of applicable law
- Your injury or death during workouts
- Your disputes with third-party services (Strava, Health Connect, etc.)
12. Governing Law & Dispute Resolution
12.1 Jurisdiction
These Terms are governed by the laws of the Netherlands, and you agree to submit to the jurisdiction of the competent courts in Amsterdam, the Netherlands.
12.2 Dispute Resolution
Before pursuing legal action, you agree to attempt informal resolution by contacting us at:

13. Severability
If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect.
14. Entire Agreement
These Terms, along with the Privacy Policy, constitute the entire agreement between you and Ergomi.
